HP takes its protection of software very seriously. Software includes software products, data bases, license keys, and firmware embedded in hardware. All are regarded as intellectual property and as such are protected by copyright law, trade secret law, contract (license) law, or patent law; or a combination of these legal rights.
HP does not sell software but instead retains ownership of the software design and code. HP grants the right to use a software product through a license agreement. This creates a contractual obligation by the licensee to adhere to HP's terms and conditions. If this obligation is not met, HP may elect to terminate the license.

Only HP or HP authorized reseller can grant a HP license and issue a license certificate/license PAK. If you are being offered an HP standard license from any other party, please contact one of our local Contacts. Purchase orders submitted to and accepted by HP or a HP Authorized Reseller will result in a valid software product license granted to the original purchaser only.
Be aware that simply receiving a Proof of License does not constitute a legal right to use the software. For standard licenses you must first sign a license contract either with HP or with a HP Authorized Reseller. For shrinkwrap licenses, you accept the license upon "opening or further use of the software."
Unless the license is for demonstration purposes, e.g., a Loan License, all licenses must be paid for. Lack of payment is cause for termination of a license agreement.
Your license with HP provides permission for you to use the software within certain restrictions. For example, some licenses permit use of the software on only a single system within a certain classification, e.g., a Workgroup system. Others permit use by a specified number of concurrent uses. All licenses restrict copying to the licensed systems as well as for backup. To fully understand your rights you should read the terms of your license agreement carefully.

You will receive a Proof of License document for each of your HP license purchases. For signed licenses these are either a License Certificate or License PAK (Product Authorization Key). For shrinkwrap licenses you will receive a License Agreement. PATHWORKs is an exception. It is provided under shrinkwrap terms, however, the proof of license is a License Certifcate/PAK.
You should make sure that your Proof of License is an original and not a photocopy. Make sure that you store your license documents in a safe place.

By making sure that you are dealing directly with HP or with an Authorized Reseller, you can be sure that your have legal permission to use the software, and that you are protected by the warranty for new license purchases.

Authorized Resellers must meet certain training requirements to better serve you. In addition, they must meet certain license requirements:
- They must first purchase licenses and equipment from HP (or specified Authorized Resellers) before sublicensing.
- They may only sell to an end-user or to another Authorized Reseller. They may not sell to another party for purposes of further selling the equipment and software.
- They may only sell an operating system license with the hardware.

Specified HP licenses can be transferred to another party with your used equipment but only with permission directly from HP, and only if policy and procedures are followed. License transfers require that a Relicense Application and fee be submitted.
